It's the shame it brings that makes it work. Why do you think there are people who have been raped, but never report it? When you think about it logically, it doesn't make sense, if they just reported the person then that person would be punished for their crimes, but yet, there are still those that don't.

You don't walk down a sketchy alleyway in the dark, because it's understood that unsavory people hang around those parts. Common sense plays a part here. If you walk in a bad neighborhood by yourself at night; understand the possibility that negative things may happen, if you do it regardless of knowing this, then you are accepting responsibility of that choice.

True for cases that could be avoided through common sense, dark alley in a bad neighborhood? Yeah don't go outside at night, however the sad fact is, regardless of whether the woman did everything right or not, public opinion in Japan would still more than likely lean towards the person who was raped being at fault rather than the rapist. For example, Consent isn't even in the equation to consider whether a case is considered Rape in Japan's legal system, the only thing that matters is whether it was conducted via "Force" or Violence. If you can't prove that it was done via "Force" or Violence, then your case holds no water and the rapist gets away free. To be eligible for "Force" or Violence, the person being raped must have done absolutely everything they could have possibly done to escape. Froze up due to suddenness of the situation? Guess you wanted to have sex you slut. Can't prove that you were under the influence of alcohol or drugged? You're lying that you were under the influence, you were actually just inviting them. It also doesn't help that Japan's police force will generally do all they can to talk you out of pursuing legal action and force you to relive the rape by requiring you to personally do a play-by-play of the situation with a doll or person and multiple officers looking at you while you reenact it and also constantly ask, are you sure you want to pursue legal action? A literal do or die mentality during the rape is required in order for the case to be in your favor and if you can't prove that you did everything you could to resist, then you'd likely lose and gain nothing but the contempt of the public for "lying".
