Due to how this is done this feels like an in universe porn parody Nick and Judy's adventure. Even down to the names being Rick and Leaps. As in universe you wouldn't be able to use the actual names since it could be sued. So you change it just enough.

As for if page 3 would be legal, it wouldn't be simply because by grabbing one "Leaps" has contaminated the evidence. Along with the fact that any confession could be considered to be made under duress. If I had to guess the real version of this would be to swap out the suspected drug with a fake. And perform the same thing, as then there is no harm, and you might be able to use their reaction as evidence that they knew what those were.
