It isn't really bestiality if the animal in question shows a real human range of emotion. In furry terms its apparently called "feral" and people have whole characters that are "feral" furries. Not sure why it isnt bestiality, just know it isn. It's fiction, so what does it matter anyway?

Either way it was hot to me, but this would technically be Beasteality. At least if you look at it from an evolution standpoint anyway. The Mare is clearly farther along the evolutionary chain then the stallion, and while this is not quite the same as a human having sex with a horse, it's more like a human having sex with a monkey, which would still be considered beasteality if you get my meaning. Of course it's still a matter of personal opinion though.

Allow me- in honesty, a furry- to explain. The primary reason bestiality is illegal (Or at least, the primary justification for illegality) is the inability of a non-sentient to consent to sex. Yes, there's people who don't like it, but hey, if a physically compatible, humanoid alien chick wanted your dick, would you say no? Starts getting a lot more difficult to flat out say no, doesn't it? Anyway, ufi mentioned the term 'feral', and explained it... well, imperfectly. In the furry world, there's actually a huge range from full animal to full human. The stallion in this comic is in the feral range- that is, appearance exactly like a normal animal (give or take a few small changes)- and the mare is in the anthro (Short for anthropomorphic) range- Much more varied in description than feral, Can have heavier or lighter animal characteristics, but, in general, has facial characteristics similar to the animal, has full-body fur (or, in some cases, scales, feathers, etc.), and has a tail matching the animal, though color is often customized to allow for more individuality in a character where many of the distinctions we as humans use to identify each other has been covered by fur. The stallion is given emotions and a bit of personality- as much as can be given to a mute in a four page porno- and the mare is obviously fully sentient. The details are arguable, but the expressions of the stallion imply that perhaps this is even a game for them, and they have their own method of communication.
Regardless of the details of their situation, he's fully capable of consenting, and in fact initiates the actual sex, being given a definite choice to just step away. Sometimes the comics don't cover this, but much of the time you'll see the feral in a comic like this initiating in some way, or perhaps even being the dominant party entirely. So by that logic, no, this is not standard 'bestiality', merely consensual sex with one character that's anthro and one that's feral. No issues there!
Regardless once again, by terms of law, I believe this would be considered bestiality- though good luck figuring out how the hell to rule this in an actual court case, could one ever be held!

And one more thing: As an extension of the earlier feral and anthro descriptions, allow me to add the following. Anthros may also have paws/claws/hooves or hands and feet, though usually the top limbs will have some sort of way to grasp things. Ears are often distinctively animalistic, even if the rest of the facial features are toned down. Between anthro and feral is a wide, multidimensional and vastly confusing to describe gray area of half-ferals who can, for example, run on two or four feet with equal skill, or may prefer one or the other, may be more hunched and have more animal characteristics... Lots of confusing stuff there. Then, on the other side of anthro is humanoids and then just plain humans. Just a step in from humans is a typical nekogirl- ears, tail, and maybe teeth or something?- then a bit further starts adding fur patches or heavier characteristics or less characteristics but more fur, and then... Well, then it gets all the worse when you add in custom species like sergals and such, which, while they may make for great porn, are terribly confusing to classify. But probably land somewhere in the half-feral range. I think.
